LAND REGISTRATION IN INDONESIA

- LEGAL BACKGROUND
By the enactment of the Basic Agrarian Law number 5 of 1960 (“BAL”) dualism in land law and land titles in Indonesia has been abolished.
Article 19 of the BAL further clarified the obligation of the Government of the Republic of Indonesia (“GOI”) to conduct registration of land throughout the territory in order to secure and guarantee anybody’s title to the land.
As implementing device, on September 24, 1961, the GOI further issued the Government Regulation number 10 of 1961 regarding Land Registration (“GR 10/1961”). Following the GR 10/1961, there are lists of supporting regulation issued by the competent authority in regard to Land Registrations.
